Hereinafter referred to as « Billposters.fr » or « the Seller ».

Article 1. Scope

These general terms and conditions of sale (“GTC”) apply to any sale concluded between Billposters.fr and any person of legal age making a purchase on the Billposters.fr website (“the Buyer”). They apply to both consumers and business customers, it being specified that certain provisions (in particular the right of withdrawal and the legal guarantees) benefit exclusively consumers within the meaning of the French Consumer Code.

Article 2. Acceptance of the terms of sale

Placing an order implies the Buyer’s full and unreserved acceptance of these GTC, in the version in force on the date of the order. The Buyer acknowledges having read them before confirming the order. Any contrary condition put forward by the Buyer is, in the absence of the Seller’s express written acceptance, unenforceable against Billposters.fr.

Article 3. Products and availability

When placing an order, the Buyer undertakes to provide correct delivery details: Billposters.fr cannot be held liable for an address error attributable to the Buyer. Orders are final only after payment. Product offers are valid within the limits of available stock.

Article 4. Order

The sale is deemed concluded after acceptance of the order by the Seller and collection of payment. When placing an order, the Buyer undertakes to provide accurate and complete details: Billposters.fr cannot be held liable for any error or delay resulting from inaccurate or incomplete details provided by the Buyer. A confirmation email summarising the order is sent to the Buyer. The Seller reserves the right to refuse any order for legitimate reasons (previous dispute, abnormal order, etc.).

Article 5. Prices

Prices are stated in euros, inclusive of all taxes, excluding delivery costs. Delivery costs are indicated before the order is confirmed. Delivery is free within metropolitan France for purchases of €50 or more. Billposters.fr reserves the right to change its prices at any time; products are invoiced on the basis of the rates in force at the time the order is confirmed.

Article 6. Payment and security

Payment is made online via the secure payment solutions PayPal (including credit and debit cards) and bank card (CB, Visa, Mastercard) operated by Worldline Sips. Banking data is processed by the payment provider using a secure protocol; Billposters.fr never has access to the Buyer’s full banking details and guarantees their confidentiality. The order is final only once payment has actually been collected.

Article 7. Delivery

The preparation time for parcels is generally 48 working hours before dispatch.

  • Metropolitan France: Colissimo with signature (delivery within 2 to 3 working days after dispatch).
  • International: Colissimo International (5 to 9 days depending on the destination and customs operations).

In accordance with Article L216-1 of the French Consumer Code, in the absence of an agreed date, the Seller delivers the product without undue delay and no later than 30 days after the conclusion of the contract. The risks of loss or damage are transferred to the consumer Buyer at the moment they take physical possession of the product. Billposters.fr cannot be held liable for a delivery delay resulting from a cause beyond its control or from a case of force majeure: bad weather, strikes, carrier incidents, customs operations, incomplete or incorrect details, or the recipient’s absence.

Article 8. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the consumer Buyer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons or incur penalties.

To exercise this right, the Buyer notifies their decision by means of an unambiguous statement (letter or email to contact@billposters.fr) or using the model withdrawal form appended to these terms.

Products must be returned in their original packaging, in perfect condition, within 14 days following notification of the withdrawal. Return costs are borne by the Buyer.

The Seller refunds all sums paid, including standard delivery costs, no later than 14 days after being informed of the decision to withdraw. The refund may be deferred until the products are recovered or until the Buyer has provided proof of dispatch.

In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to products made to measure or clearly personalised at the Buyer’s request (in particular limited editions and original creations produced specifically for them).

Article 9. Legal guarantees

Independently of the right of withdrawal, the consumer Buyer benefits from the following legal guarantees:

  • the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code), which allows them, for 2 years from delivery of the product, to obtain the repair or replacement of the non-conforming product, free of charge;
  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code), which allows them to act within 2 years from discovery of the defect.

To implement these guarantees, the Buyer contacts Billposters.fr at contact@billposters.fr.

Article 10. Return of a defective or non-conforming product

In the event of an apparent defect or non-conformity noted on receipt, the Buyer informs Billposters.fr as soon as possible. After verification, Billposters.fr proceeds, at its choice and depending on the case, to replace the product, refund it, or issue a credit note. The product must be returned in its original packaging. The return costs for a non-conforming or defective product are borne by the Seller.

Article 11. Personal data protection

Billposters.fr processes its customers’ personal data in accordance with Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the French Data Protection Act. The data collected is necessary for processing orders and managing the customer relationship. The Buyer has a right of access, rectification, erasure, portability, restriction and objection, which they may exercise at contact@billposters.fr, as well as the right to lodge a complaint with the CNIL (the French data protection authority). Article 12. Intellectual property

The Billposters.fr website and all its content are the property of Éditions Langlaude. The information published, the images reproduced and the texts are protected by intellectual property rights. The trademark, logos and layout may not be reproduced, represented or used, in whole or in part, without the prior written consent of Éditions Langlaude.

Article 13. Governing law and disputes

These GTC and the sales concluded on Billposters.fr are governed by French law, regardless of the Buyer’s country of residence. In the event of a dispute, the Buyer first contacts the Seller to seek an amicable solution. Failing an agreement, the dispute is brought before the competent courts in accordance with the ordinary rules of law; the consumer Buyer retains the option of bringing the matter before the court of their place of residence.

Article 14. Force majeure

Billposters.fr’s liability cannot be engaged in the event of non-performance or delay resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code.
